How are senators elected ?

The Senate has 81 senators elected in 81 constituencies

Constituencies for Senate elections

The first elections took place in 1996. A third of the senators were elected for 2 years, another third for 4 years and yet another third for 6 years. The subsequent elections took place in one third of the constituencies in 1998. Following these elections, all senators have been elected for 6 years.

The term of the Senate election is announced by the President of the Republic according to the Act Nr. 247/1995 Coll., on the Election to the Parliament of the Czech Republic.

Every other year, elections take place in one third of the constituencies, which makes the Senate a permanent institution that cannot be dissolved and continuously performs its work.

The constituents elect Senators from among candidates nominated by various political parties or from among independent candidates. Candidates acquiring more than 50% of the votes cast shall be elected Senator. If none of the candidates gets this quorum, a second round of election is held between the two candidates with the highest numbers of votes. The second round goes to that candidate who gets the simple majority of the votes.

All Czech nationals 40 years of age and older may be elected Senators. Senators are elected by constituents 18 years old and older. Also incumbent Senators may run in elections so if elected, they may remain in office for several terms. Each elected Senator receives a certificate of regular and legal election from the election committee. Senators are required to take an oath at the first Senate session following the election.

If the mandate of any Senator is cancelled during his/her term of office for any reason, the President of the Republic shall announce by-elections in his/her election district in a way ensuring that they take place no later than 90 days after the senator’s mandate is cancelled. In by-elections each new Senator is elected only for the rest of the term of office of the original Senator whose mandate has been cancelled. No by-election shall take place if the senator’s mandate is cancelled in the last year of his/her term of office.
